MGT611 - Business & Labor Law GDB No.1 Due date 20-11-2015

Mr. Hassan runs a business of second hand car sales and rent a car. One of his friends Mr. Zain wants to purchase a well-conditioned car from him. He shows a number of cars to Mr. Zain who finally chooses an 847 cc car. Both settle the price and it is decided that half payment will be received in advance and car will be delivered after one month by receiving the remaining half price. The agreement is drafted in written form. After the agreement, Mr. Hassan rent out that car to one of its customers for ten days. After use, the customer returned the car in damaged condition. Mr. Hassan gets the car repaired without informing Mr. Zain and on completion of one month sends it to Zain’s place and demands the remaining amount. When Mr. Zain observed that car has been recently repaired, he refused to take delivery and asks Mr. Hassan to return half price paid by him. Mr. Hassan, on the other hand, asks him to take the delivery of car by refereeing to the agreement made by them.
Required:
1)      Describe the status of contract at the beginning and after ten days.
2)      Is Mr. Zain right in claiming his money back? Why or why not?
3)      Is Mr. Hassan right in forcing the contract? Why or why not?
